.Information about Migrant Bust Card

This has been created based on personal experiences. It provides minimal and necessary information to avoid detention during an immigration raid on the streets and a step by step guide on how to act .promptly in the event you are detained
له‌ بنه‌ڕه‌تدا ئه‌م شێوه‌‌ کارته‌ی په‌نابه‌ر به‌پێی ئه‌زموونی که‌سیی دروستکراوه‌. ئه‌م کارته‌ به‌شێکی که‌می له‌ زانیاریی پێویست له‌خۆگرتووه‌، تاکو له‌کاتی هه‌ڵمه‌تی سه‌رشه‌قامه‌کانی کارمه‌ندانی فه‌رمانگه‌ی کۆچبه‌رییدا له‌ده‌ستگیرکردن دوور بکه‌ویته‌وه‌. هه‌روه‌ها هه‌نگاو به‌ هه‌نگاو نیشانی بدات که‌چۆن به‌شێوه‌یه‌کی خێرا ڕه‌فتارت له‌گه‌ڵدا بکرێت، کاتێک ده‌ستبه‌سه‌رده‌کرێیت.

.If you are taken to a detention centre
ئه‌گه‌ر بۆ سه‌نته‌ری ده‌ستبه‌سه‌رکردن گوێزرایته‌وه.

.They will take away phones with camera and internet access
ئه‌وان موبایله‌که‌ت لێده‌ستێنن ئه‌گه‌ر کامێرای تێدابوو، وه‌ هێڵی ئنته‌رنێته‌که‌شت ده‌بڕن.

.But you have the right to keep a phone without camera or a SIM card
به‌ڵام مافی خۆته‌ موبایله‌که‌ت لابمێنێ،‌ ئه‌گه‌ر کامیرا و سیم کاردی تێدانه‌بێت.

You will receive documents with reference numbers from the Home
.Office or a Port Reference from the Detention Centre
ده‌بێت له‌لایه‌ن هۆم ئۆفیس یان سه‌رچاوه‌ی جێبه‌جێکه‌ری سه‌نته‌ری ده‌ستبه‌سه‌رکردنه‌وه‌ چه‌ند دۆکمه‌نتێکت به‌ ژماره‌ی ڕیفره‌نسی خۆته‌وه‌ پێ بگات.

.These numbers will be required by lawyers and immigration officers
ئه‌و ژماره‌ی ڕیفره‌نسه‌ی تۆ، له‌لایه‌ن پارێزه‌ریان کارمه‌ندانی فه‌رمانگه‌ی کۆچه‌وه‌ داواده‌کرێت‌.

!Keep these documents handy and in order at all times
ئه‌م دۆکمنتانه‌ لای خۆت هه‌ڵبگره‌ و هه‌رکات داوات لێکرا با له‌ده‌ستدابێت!

!Share this information with people that you trust
متمانه‌ت به‌‌هه‌ر که‌سێک هه‌یه‌، له‌م زانیاریانه‌ به‌شداری بکه!

.'To obtain legal help، you should register ASAP at the ‘welfare office
بۆ ئه‌وه‌ی یارمه‌تی یاسایی به‌ده‌ستبێنیت، پیویسته‌ به‌زووترین کات ناوی خۆت له‌ ئۆفیسی چاودیری کۆمه‌ڵایه‌تی تۆماربکه‌یت.

.If there isn’t one at your detention centre، you can do this in the library
ئه‌گه‌ر له‌ سه‌نته‌ری ده‌ستبه‌سه‌رکردنه‌که‌ت ئه‌م ئۆفیسه‌ نه‌بوو، ئه‌توانی له‌ کتێبخانه‌ ئه‌نجامی بده‌ی.

.You have the right to an interpreter in your language at this stage
له‌م قۆناغه‌دا مافت هه‌یه‌ وه‌رگێڕی تایبه‌ت به‌زمانه‌که‌ی خۆتت هه‌بێت.

:There’s two ways to get
دوو ڕێگا بۆ ده‌ربازبوون:

Bail.1
1.به‌ردان

.You have the right to apply for this from the day of arrival at the detention centre
له‌و ڕۆژه‌وه‌ ده‌گه‌یته‌ سه‌نته‌ری ده‌ستبه‌سه‌راگرتن مافت هه‌یه‌ داوای به‌ردانت بکه‌ی.

.You will need two guarantors، and complete an application with the help of a lawyer or organization
تۆ پێویستت به‌ دوو متمانه‌ده‌ر هه‌یه‌، وه‌ ته‌واوکردنی داخوازینامه‌(ئه‌پڵیکه‌یشن) له‌گه‌ڵ یارمه‌تی پارێزه‌ر یان ڕێکخراوێک.

.A Judge will make a decision about your situation
دادوه‌ر ده‌توانێ بڕیار له‌و حاڵه‌ته‌ی تۆ بدات.

2. Temporary Admission
2. ڕێپێدانی کاتی

.You may apply for this if you have been in detention seven days
ده‌توانی داوای ڕێپێدانی کاتی بکه‌ی ئه‌گه‌ر ماوه‌ی حه‌وت ڕۆژ بێت له‌ سه‌نته‌ری ده‌ستبه‌سه‌رکردن بیت.

Fill in the applications at the welfare office or library. For this application no you don’t need a lawyer or guarantor، but you must provide an address or valid reasons to get out (personal relationships or .children with EU citizenship
داخوازینامه‌(ئه‌پڵیکه‌یشن) له‌ ئۆفیسی چاودێری کۆمه‌ڵایه‌تی یان کتێبخانه‌ پڕده‌کرێته‌وه‌، پێویسته‌ تۆ ناونیشان یان هۆکاری یاسایی نیشان بده‌یت، بۆ ئه‌وه‌ی بچیته‌ ده‌رێ (په‌یوه‌ندی کسێتی یان مناڵ له‌گه‌ڵ هاوڵاتیبوونی ئه‌وروپی.).

.You may also use articldes 3 and 8 of the Universal Declaration of Human Rights
پێویسته‌ تۆ به‌ندی 3 و 8 ی جارنامه‌ی جیهانی مافی مرۆڤ به‌کاربهێنی.

.Article 3: Everyone has the right to life، liberty and security of person
به‌ندی سێ: هه‌موو که‌س مافی ژیانی له‌ ئازادی و ئاسایشی مرۆڤانه‌دا هه‌یه‌.

Article 8: All are equal before the law and are entitled without any discrimination to equal protection of the law. All are entitled to equal protectionagainst any discrimination in violation of this Declaration and
.against any incitement to such discrimination

The application is sent directly to UKBA officers
.in the detention centre where you are held
داخوازینامه‌ (ئه‌پڵیکه‌یشن) ڕاسته‌خۆ بۆ کارمه‌ندانی ئاژانسی سنوری شانشینی یه‌کگرتوو UKBA له‌و سه‌نته‌ر‌ی ده‌ستبه‌سه‌راگرتنه‌ی ‌تۆی گلداوه‌ته‌وه‌ ده‌نێردرێ.

Bear in mind that the address will be asked so the authorities can make
.sure that you have a place to go back to

Unfortunately، they do have the right to Question you if they have a Reasonable suspicion

According to revisions made by UKBA on Chapter 31 of its Operational Enforcement Manual، :Immigration Officers have to follow this procedure
به‌پێێ بژارکردنێک که‌ له‌لایه‌ن UKBA ئه‌نجام ده‌درێت له‌به‌شی 31 پرۆسه‌ی ڕابه‌ر Manual)) به‌زۆر سه‌پاندن، کارمه‌ندانی فه‌رمانگه‌ی کۆچبه‌ری به‌پێی ئه‌و فه‌رمانه‌ کارده‌که‌ن:

1. Identify them selves and show a warrant card
خۆیان ده‌ناسێنن به‌ ده‌رخستنی ئه‌و پێناسانه‌ی پێیانه:

2. Give a valid reason to stop and ask you questions
هۆیه‌کی گونجاو پیشان ده‌ده‌ن بۆ ئه‌وه‌ی بتوه‌ستێنن و پرسیارت لێده‌که‌ن.

Tell you that you are NOT obliged to reply to any of these questions .3
ئه‌وان پێت ده‌ڵێن که‌ زۆرت لێناکه‌ن وه‌ڵامی هه‌موو پرسیاره‌کان بده‌یته‌وه‌.

4. Tell you that you are NOT under arrest and that you are FREE to go if you want

.You have the right to not reply to questions

.Remember that it’s NOT in your interest to reply to questions about your identity or migration

.Status; this would allow them to gather evidence when they actually have nothing against you
